I can tell you from my past dot com bust experience, getting companies to file for GC had become very tough. Getting labor certification cleared was even a bigger challenge. I can say, when economy goes south, immigrant's life gets tougher. Hope for the best, prepare for the worst.

I would like to know your advice,
My details are
- EB3 / Labor filed and approved during July/2007
- I140 & I485 filed concurrently during August/2007
- I140 got approved on Jan/16/2009
- EAD Renewal is made and existing one is valid till Nov/2010
I have only labor number, 140 approval notice with me. where as I do not have labor complete job description.
As of now
- Can I change my employer without any labor job description?
- Does my employer has still rights to revoke I140?
- How can I change job to new employer and protect myself from I140 revoke by existing employer?
- GC filing expenses was completely bared by employer only.

Can I file I-485 for self and I-824 (application for changing AOS to CP for approved immigration petition) for dependents, if depedents won't be able to come within a year? If yes, how much time will take to transfer case from AOS to CP?

Sorry for the cross posting.
My papers were sent on June 21st, but they were receipted only on June 27th. Turns out USCIS returned my $1000 for premium processing :(.
My lawyer said they talked to USCIS and USCIS asked them to re-file with proof of receipt.
Did anyone who filed in end June have their 140 premium processing returned?

If you have a valid I-94 i.e. not expired, you can apply for another I-539 to F1 - make sure to make the application stronger than last time.
If your I-94 is applied, you have no choice but to leave the country and get F1 visa in your home country and come back.

This is such an open ended question. It will be very easy to answer if you can add few lines about your background, affordability and qualification(like GRE etc). If not the school names will be all over the place from MIT to the ABC University....as the word "Good School" is very subjective.

Hello All,
I am currently working for Employer A for the past 6 years and my current H1 is Expiring in May End 2010. MY employer says he will file the H1 in may starting. In the meantime I got an offer from a future employer B who applied for my H1 transfer in premium processing. We got an RFE and the new employer is working on that .
My question is that lets say After responding to RFE by my future employer B , god forbid say the H1 transfer is denied. Would this denial have any impact on the H1 Extension that my current employer A plans to file in couple of weeks using I-140 approved petition. Please advice ?

Hi,
I received my EAD today, but my I-140/I-485 are pending. Is the EAD of any use right now? I think I have to wait for the I-140 to be approved before changing jobs, right?
