The Supreme Court issued its decision in the Arizona business license/e-Verification law of 2007 and by a 5-3 margin has upheld the law. This is the law that allows the state to revoke business licenses for firms knowingly hiring unauthorized workers and also mandating all employers use E-Verify. This was always going to be an easier case for Arizona than the defense of its 2010 law. USCIS is reporting that as of November 6th, 54,900 H-1Bs had been issued against the 65,000 annual quota. While this represents a dramatic drop in H-1B applications over previous years. In 2007, nearly 200,000 applications were filed in the first week applications were open and in 2009, the application period is now in its seventh month. Usage seems to be about 1,000 cases a week so we're probably looking at January or February to run out of numbers. Incidentally, yesterday I was the moderator of a panel on the impact of the global recession on national migration policies in Amsterdam....

Need advice on how to reopen a bia appeal. We have vacated an aggravated felony Sept 25 that precluded any relief. Ninth circuit review pending and im seeking an extension on the opening brief until I find out bia status. The question I have is if i should just use IAC as an argument or just try to reopen based on a material change? I dont want to open a "can or worms" but the attorney throughout the 5 year court proceedure never advise to vacate or any post conviction remedies. Bia appeal decision Apr 29/09 is past the ninty days.

I just received an 3 year h1-B extension based on an approved I-140. I had only 2 years left of 6 year h1 limit but because I have an approved I-140, I got one more year.
I attached my approved I-140 copies along with H1B extension application but the Alien number A# on this new H1-B extension approval is different than what I have on I-140 approval notice. Actually its a typo, instead of A 08 it A 008 and because of one extra zero the last digit is lost.
Is this a matter of concern? Please help.

Can this agency be any more incompetent? This will likely lead to lawsuits by those who were "mistakenly" notified that they were selected. Glad I didn't get a notice this year. I would be very upset.

On March 12 2009 I got an query on my I-485.
Requesting discrepancy in the labor applied on Nov'7 2002 and present working place.
My company(abc ltd) applied labor on Nov'07 2002 while I was working at the clients(xyz) place in Los Angeles.
I got my I-140 approved on Feb'15 2006, while I was with the same client(xyz) at that time.
On Dec'04 2006 I moved to Detroit, started working with different client.
RFE goes like this.
The Documentation submitted with your application and/or a review of service records indicate that you no longer reside in the same state or geographical location as the underlying form i-140 immigration petitioner and /or job location specified by your intended permanent employer.
There fore submit a currently dated letter from your original form I-140 employer which which address this discrepancy.
I am still working with the same employer who filed my labor certification.
Any gurus who can suggest me on the query would be greatly appreciated.

I was working for a telecom company. I passed 6 years and then was on 1 year extension. Meanwhile my I140 was approved. Lately i was given pink slip and then transfer my H1 to another company. i couldn't join the company since i was waiting for approval notice for my H1 Transfer. Today i received the denial notice for my H1 transfer and extension. I called to the lawyer and they told me to file for B2 as they haven't received the notice as of yet. So the reason of denial is still unknown. I was wondering what are my current options? Should i wait and file a motion for the H1 transfer denial or should i go ahead with B2? Please advise.

Does any one knows why EB2 India is not approving in comparison to 2006.
As my understanding that USCIS should process application in FIFO and PD.
My PD is Feb 2005 and when I talked to CS he told me that everything is cleared and my case should be approved .
He told me to call after 68 days ( don't know why) if my case is not approved till then.I am seeing peoples with 2006 PD are getting there GC .

Hi everyone,
I have come to this form for help of one thing: for a long time I know that when switching jobs using ac21 you need to make sure that the job code is same and job description is similar, i know from my approved 140&perm that mine is 15-1032 (computer engineer),
the job description of both company are 90% same.
But they know nothing about the job code and ask me what is this code and where this is used . Can somebody help me with this?
btw, my old job title is computer engineer, my new title is manager of computer system engineer. is that a problem ? if yes , if I asked them to demote that to computer system engineer leader, is it better?

I am planning to apply for Alberta Nomination Program under NOC (Manufacturing and Industrial Engineers). Does anybody has any experience with this NOC. Also, I need to know how does this process work. I apply for ANP and when I need to move I apply for jobs and then I get work permit...right ? Then if I need to get a TN visa to come back to usa how do I do that. I have a house in chicago, so wondering if renting that out could be an option for me when I immigrate to alberta so that when I need I can come to chicago. I am in my 5th year of H1B and with the current scenario my present company is not going to start my GC (it stopped because of layoffs in the company).
