there are two choices for - I140 Filing Type
- Regular
- Premium
What is the difference b/w two. Can EB3 candidate file for I140 Filing Type in Premium category.

Hi,
My Priority date is Jun 2006/EB2 India. After the Aug bulletin I'm now afraid that my priority date might get current next month.
My concern is that I might be getting married in the near future and I don't want to deal with an immigration nightmare for my spouse. At the same time I don't want to rush a decision like getting married based on USCIS priority dates. Is there anyway I could delay my GC adjudication for 3-4 months to get some more time ...

Hi.
My Wife is currently in H4 Visa and in US now. She has total of 11 years IT experience. She lastly worked with a Company X from May 2004 to May 2008 for about 4 years. Currently she is not an employee of Company X and also not working anywhere.
If the same Company X gives an US offer, Is it possible for the Company X to file L1 visa for her so that she can start working for that company immediately ? ( I have read in immigration forums that the L1 Visa Eligibility is that the person should have worked for that company for atleast 1 year within the last 3 years)
Experts, Can you pls give your opinion and suggestion on this ? If so, how long the process takes place for transfering from H4 to L1 visa ?

I am in the process of applying for the green card but as the labor department was delayed to send the paperwork by status became out of status, my lawyer suggested me to go back to my country apply for H1B visa and come back. That is why I want to apply for H1B visa . My lawyer tells me that there is no way I can get an approval if my company doesnt show tax return documents for the last 2 years. Is it true or there is another way or documentation which could be used in order to apply for the visa? My boss doesnt want to show the tax returns but accepts to show a bank account and different type of paperwork such as franchise agreements or certificates.
Can you please let me know if my lawyer suggests me the righ way if not which woudl be the best way to continue my green card process and get a result as soon as possible.

Hello All,
Being on H-1 never allowed you to get promoted unless the employer did all the necessary paperwork with USCIS/DOL. EAD being work authorization not limited to current employer, can EAD mean a little more freedom to waiting-for-GC H-1Bs in terms of being able to get promoted within the organization, get different job titles, etc ?
Also, I have 140 approved and H-1B ext was granted for 3 years (till 2010). Does it make any sense to apply for EAD alongwith 485 ? If EAD gives the career advancement opportunities, can I apply for it but keep using my H-1B to re-enter US till 2010 if needed ?

once 140 is approved, one can port the PD. Doesn't matter whether it was LC SUB or not. My personal understanding, check with a lawyer.
However this practice is long gone (discontinued since second quarter of 2007) and no more LC SUB is allowed.
I am wondering, I assume that you must have done this prior to second quarter of 2007, then you may have also filed 485 based on this 140.

i am currently on H-1B with employer A. i hv a job offer from employer B which is a mgr role based outside USA.
i know that if i work for 1+ yr with employer B outside USA then i can come back to USA on L1-A visa.

My I140 (Bachelor degree, EB3, PD: Nov'04) was approved last month from my previous employer.
I completed my MBA in Jun'06 and joined another company; my job description has changed totally and I can't use previously approved labor for my new job. My new employer will initiate the process of labor, next week.
I checked with my previous employer and he informed me that he is ready to give me a support letter, if I want to go ahead and file I485 based on EB3 I140.
Questions:
Is it possible to file I485, even if we are not working with the employer?
Once I have filed I485 based on my EB3 I140, and if the application remains pending for next 6 months, is it still possible to port the PD (Nov'04) to the new EB2 based petition?

I work for one of the biggest software companies which deals with PERM cases a lot. However, my case got audit notice and I'm really confused now.
My PD is Jan-19-2009 and I received my audit notice in 11/2009, and we replied in 12/2009. I just learnt today that it might be very likely to take more than 2 years to clear such a case and there is possibility to be denied.
I'm very worried that I might lose my PD, is it really true that my case won't be cleared for at least another year?

When started working for Company A it used to operated from 2 diffrent locations Newjersy ,New hampshire (Excutive office).
My Company applied Labor from NH in March 2005 (before perm).6 months back my case was moved to New York regional center ( i am not sure why it is moved to NY insted of newark NJ).
Recently they closed (in April 2010) the NH Branch .
What will happen to my green card ..? (labor is applied for NH location)
When i check with my employer he is saying NH location is Executive office it will not have any impact .
if reuqired he is ready open office in NH with new address
What should i Do...? i am totally in confusion state .. and now my dates current from july ,2010.

I would suggest keep Visitor Visa appointment on separate date as your parent will not have option saying they want to meet kids and spend more time with you.

in order to get the animation to 'stick' you have to toggle that button that says "animate" on the top of the screen. The reason they do it that way is this. If you've already set up an animation, but then find that you need to change something in the basic structure of the item, you can turn off that toggle, edit the item and have it not effect the animation that you set up.
