    have you guys lost the ability to think and read...
    It is USCIS that decides the categories and it is they who say that EB1 is more skilled and valuable than other categories
    Again ... like I said in my post .... It is NOT NOT individual's qualifications or Country that matters, it is the JOB descr they do that decides the EB category. IF USCIS places more value on EB1 than EB2/EB3 category jobs that is not my problem .... but thats the way it is... and that was my point .... if the value placed on the job is higher that job...

    If things make you sick .... there is a fix for it .... go to a doctor ...
    But truly... I do believe you are sick, inability to coherently digest a discussion and think is a serious anomaly and you should get it checked out...

    Herez the qualifying criteria for various EB categories.

    FIRST PREFERENCE Includes:

    Intra-Company Transfers - Executive or Managers
    Outstanding Professors and Researchers
    "Extraordinary Ability" in the sciences, arts, education, Business and athletics
    Note: Categories 1 & 2 do not require a labor certification7 Category 3 does not require a labor certification or offer of employment.
    SECOND PREFERENCE Includes:

    Professionals with advanced degrees
    Aliens of "Exceptional Ability" in the sciences, arts or business
    Note: both categories require an offer of employment and a labor certification unless a "National Interest Waiver" is obtained.
    THIRD PREFERENCE Includes:

    Professionals with bachelor's degrees
    Skilled workers filing positions requiring at least two years of training and experience
    other workers.

    Every category includes skilled professionals.

    The classification is based on education/priority/years of exp.

    We all have the option to apply for a "better" category, but we choose not to because either we don't have supporting documents or our employer refused to do so.

    We should stop infighting and focus on bigger issues at hand.

    Yep. My impression is that IEEE USA is anti H1b, but it supports EB visa. For those who rail against desi consulting firms, IEEE USA is the friend, not the foe.

    On the surface, yes, IEEE-USA supports EB visas and opposes H1-B visas. But if you take a closer look, its not as clear cut as that. What they really want is to restrict immigration to the most exceptional foreign scientists and engineers (roughly those who would qualify for EB1), and make the path to a GC faster for them. They are dead opposed to foreigners being hired for general engineering jobs, and the current practise of almost everyone on an H1-B being eligible to apply for a GC. I would think twice before calling them a friend to any of us; they are at best anti free-trade restrictionists minus the rabidity and political incorrectness of our "friends". A while ago there was a discussion on IEEE-USA's reaction to CIR, where they expressed displeasure on the increase in H1-Bs along with the increase in permanent visas.

    I think I know how this works. They would outsource this program to some govt contractor (or ask the govt contractor who is working on their data ) to produce that report which costs (<10$ worth of time/effort, if they have all the data).

    If all they want is money ..so be it. I am ready to pony up $50 for this,if we all approach together. But as someone suggested country of chargability is a must.

    You are right!!!. Hearing from the candidates, i was wondering if they will ask us to have some Voluntary Military/Community Service to be done to Qualify for GC and Citizenship.:D


    dont be confused with "legal immigration", legal immigration in obama's world means family based immigration (vote bank politics) not EB immigration.

    In such cases, where the InfoPass people (IOs or VOs or whatever they are called) pass judgement on whether your 485 should be approved or not, does it help to bring a printed copy of the AC21 Aytes memo (issued in Dec 2005)along to show to them? It is an official USCIS document and it clearly states the following.

    Question 11. When is an I-140 no longer valid for porting purposes?
    Answer: An I-140 is no longer valid for porting purposes when:
    A. an I-140 is withdrawn before the alien�s I-485 has been pending 180 days, or
    B. an I-140 is denied or revoked at any time except when it is revoked based on a withdrawal
    that was submitted after an I-485 has been pending for 180 days.

    Well - what is the point? I will take all documentation if it is an interview, in fact I will take lawyer for interview. When you go for interview, take kids and spouse and lawyer - don't go alone.

    One must not expect much from Infopass. If you get info - great if not - jst leave it.

    desi9333 thanks for the link. Nice one - even though it covers only Hiring practices, and not opportunities for promotions and progression.

    The "Opportunity" usage has been explained much beyond Hiring in the other laws and related documents. Hence, an employee who subsequently faces discrimination because he/she cannot progress or misses on job advancements due to Visa limit restrictions is certainly being discriminated against.

    You are wrong here. Equal Opportunity Law does not apply to Immigrant Visa allocation. PERIOD.

    Example:
    Employer XYZ has 3 employees on H-1B. Its upto Employer's choice to file green card for any or all of them. Employer may decide to sponsor employment based green card for only 1 of them. This is perfectly ok and does not come under employment based discremination.

    Like I said multiple times, spend some real money to get professional advice from attorney. May be that will enlighten you. Talk is cheap and so is being in dremaland.

    Since you are a Canadian you can apply for a visitor visa (B1) – by applying the visa we will be in legal status until a decision is taken. B1 visa is generally approved if you give the reason of finishing up matters in US (like selling house/cars/closing bank accounts/credit accounts etc). I guess you are asking just to be informed but if it really happens another option for you is TN1 – if you have not yet applied for 485.

    But they never know when you leave really, at least if you're canadian. By going home, all I do is give the CANADIAN immigration officer the i-94 paper with the h1 stamp when i enter canada if i don't plan on returning to the US again, at least on that visa. Plus, they never ask, so it's really up to you to give it to them. And getting a visitor visa, canadians automatically enter on 6month visitor status as default, no stamping required. If you're flying, all you have to do is tell them you're coming back to canada. If you drive across the border, they don't care to ask. So i guess i can just hop back to vancouver for a weekend and come back as a visitor and be fine then (to clean up affairs, or just hang out for 6 months).

    Let me ask you the opposite question : How does NOT passing CIR help us ?
    I bet you don't have a convincing answer for that. Therefroe, it follows that CIR (even if it is not ideal) will be better than no bill being passed.

    And all those anti-CIR folks please get this : It does NOT give instant citizenship to anyone, nor does it put these folks ahead of us in the line. Thats just rhetoric from the likes of numbersUSA and lou dobbs blindly being parroted by some morons/idiots/imbeciles here. The core team had repeated this several times when CIR was under discussion. CIR is definitely not ideal for us because of the possibility of collateral effect from USCIS being overwhelmed, but is that worse than our current situation of waiting till retirement for our PDs to become current ?

    As rheoretro mentioned in an earlier post "Burning someone else's house down is not going to help us build our own". That is particularly true for us .. those who who are against illegal aliens are also against high skilled legals with a few honorable exceptions like Cornyn and Kyl. If that wasnt the case, the house and the senate would have passed SKIL in a jiffy by now. Its best for us to remain neutral on the illegal alien issue .. and back it to the extent that it benefits us through a piggy back ride.

    Actually I do have a convincing answer... whether or not that bill passes, we are in a lose-lose situation. I have read the bill (not in its entirety like I already stated). I know that the amnesty section already specified there will be no immediate granting of citizenship, excepting the wording for those who have been in this country for more than 5/6 years seems to imply they would get citizenship (again, the way a bill is worded can be twisted in future).

    What I am worried about is, I get the feeling this is going to end up dipping into our EB3 pool... we previously had a Sched A for physicians and nurses that took numbers out of EB3 exclusively for them.

    And I don't listen to Lou Dobbs or NumbersUSA rantings. But if you kept your ears open more than 6 months ago, you would also have heard some Dems says some not-so-friendly things about us.
    One prominent Dem senator said H1-Bs are not suffering as much as illegals.
    Another prominent Dem said this country needed more farm workers, not more IT / skilled ppl.

    Yes....Each employer must file for New H1B. But it does not invalidate the current H1B, untill its revoked by the employer.

    bigboy.. We need about 20 volunteers per state to pledge 200 letters each. It is achievable. But 20 volunteers is far from reality. That is our challenge.

    Friends Please dont jump on me as i make these comments. I am doing my best to convince ppl as i see across to Join IV and contribute to our efforts. But i also think that every state chapter should allocate some members who only concentrate on grass root efforts but nothing else to track how many memberships and etc and those should co-ordinate with every state to see how much they can target and how much did they reach. I know this might have been thought by some others but just what i am thinking ?

    Your points are good. It is like a group of surgeons, coming out of OT (Operation Theatre), sweating it out, congradulating each other, and saying, 'the operation was successful. but in the end the patient died'.

    We need a direct approach to stall this unethical cornering of 90000 visas exclusively for Sch A workers. To put it in an American way, PERIOD.

    The reason we see progress year after year with Schedule A and nothing happens in EB reform because there is no corporate support for EB reform. This is one of the reaons why we should be open for measure like 485 whenever possible, even after febuary 15th.

    Maybe we need to figure out how we can involve the corporations in EB relief. The only reasons we see Schedule A relief every year because there is a strong health industry lobby driving this. the worst part about this is that these 90,000 and 50,000 which were released last year and they are trying now are comming from the unused\recaptured visas from previous years. there is no country limit in the unused\recaptured visas for Schedule A.

    when it comes to us we cannot get unused visas and added to that somebody always tries to add country limit to even unused\recaptured visas. Its a double whammy for EB retrogression. May god help us.
