My daughter (5 yrs) is an US citizen and having passport valid until end of Sep 2009 and having POI card for 15 years from Indian consulate.
Now I am planning to take her to India for 3 weeks from Aug 1st week. The travel agents says her passport should have at least 6 months valid from the date of date of the return (Aug 4th week). Is that true/correct? Can she enter here in USA after her India visit with 20 days left in the passport validity?
I will be using my AP though I maintain H1B status (I-797) and work for the same employer.

Guys,
Just want to share my latest info. As you know my case has been stuck in Boston-CIS since May 22, 2007 after interview. Latest SR got me a letter yesterday from local office stating "need to perform additional review...blah...blah..." On other hand I got another letetr last week from CAO-USCIS as Washington signed by a supervisor staing that my case is stuck coz "I never attended NSEER interview in 2003 and as a ocurtesy she has arranged for my interview at ICE office in Boston". I was amused coz my passport is littered with NSEER stamps and I had the same RFE during one of EAD renewal and after the reply they promptly approved the EAD!
It speaks volume about USCIS's efficiency. Anyway, I'm saving all these letters and will file WOM at the beginning of next year.

As of April 6, 2009, all applicants for non-immigrant visas at the U.S. consulate in Ciudad Juarez, Mexico, must now enroll at the Applicant Service Center (ASC) fingerprint appointment before attending the interview appointment. Can labor and I140 be filed from an employer, even if employee is not working for that employer currently, may be with the intention of joining that employer at later date? Please reply.

Yes. GC processing is for a future job. So, labor and I-140 can certainly be filed without being on the payroll. I think I-485 also can be filed before joining the firm. But you should confirm this part from a lawyer.

If I were going to spend over a year in a country which required a visa to visit (such as Nigeria), in order to study the local culture, which kind of visa would I need to obtain before hand? Business, work, study, visitor, etc?

Pew confirms what we've already assumed is happening. The number of illegally present immigrants has dropped 8% since 2007. The number is now about 11 million, down from peaking at 12 million. The annual migration of illegally present immigrants has dropped from about 850,000 a year a few years ago to just 300,000 a year today. Why? The USCIS, on May 18, 2009, once again provided an update on the number of filings for H-1B petitions for the fiscal year 2010 program.
It announced that it has received approximately 45,500 H-1B petitions counting toward the Congressionally-mandated 65,000 cap. It continues to accept petitions subject to the general cap.
I can report personally that the most recent H-1B regular cap I-129 petition that I filed was filed on May 11 and it was approved on May 15 � premium processed.
Also, the USCIS announced that is has received approximately 20,000 petitions for aliens with advanced degrees, consistent with its prior update and it reconfirmed that it is still accepting advanced degree petitions because it assumes that not all the petitions it received are approvable.
It�s beginning to look like the cap isn�t going to be reached any time soon and, who knows, maybe not at all this fiscal year.

If we lose our job after having the I-485 pending for more than 8 months, I-140 approved, how much time do we have to find another job?
Do we have to immediately withdraw the petition after losing/quiting a job?

The advice i got is that you should be in a new job ( and notified USCIS about usage of AC21 ) before,
1. The I-485 is approved
2. Any RFE directed to the old employer
I don't think one needs to withdraw application.
