One more in same boat here .. EB3 India approval email received.. Dependent not approved , RFE for photos on EAD application .. EAD expires in one month ... lot of frustrations and trouble on my way I guess!!!!
Though I haven't been able to get proper info from INS, I believe my approval is legit. I have had an EB2 I-140 approved in 2006 from a different employer. The GC approval notice shows the PD of 2002 (EB3 PD) and category of E26 (which I have learned EB2).
It looks my case is considered as 2002 EB2 , if I ever knew this I could have tried to get an approval earlier.

1) Asking for money to issue a report under FOIA cannot be justified. If the data is public, it is USCIS's job to bring it to us.
2) It is certain that we would be able to get USCIS to waive the $5k fee... but it would take time.
3) If we pay up and they make the program... we need a way so that we can request the reports at regular intervals... after all once the report is prepared, it is available and we should be able to make use of it.
4) A better idea might be to pay the $5k, but instead ask them to make an API.. to which one can we can supply the boundary priority dates using a RESTful service. If we are gonna give money.. we better get the restrained control in our hands. This will help future applicants.

First of all I think logiclife will go in the history of immigration books as the movers that existed in this generation. I am amazed at how motivated the IV core team is and how smoothly they have organized the whole show so far.
I salute you. Hats off to you guys.
I read a lot of newspaper articles after the rally and they always seemed to mention that Indian and Chinese legal aliens protesting backlogs. I think there should be some effort to also include people from other nationalities such as Russians, Englishmen, Philipinos, Chinese and other nationalities. Now I know they are not hit as hard as us but they go thru some serious backlog as well if they are in the EB3 category.
Question is I am thinking how?
Any ideas guys?

Just curious, and thinking loud: if there is a limited and reduced number of H1B workers come in, in the long run the number of applicants for permanent residency will be shrinking too (at least EB category). To reduce EB GC applications, and preserve the americanness of the employee-pool, this seems to be a nice and covert trick, at least to me. Let few people come for 6 years, and so fewer may remain as GC holders. Maybe I am missing something here.
When they reduce H1 B why do not you think about reducing immigrant visas like EB based.

Please understand that your older PD is much more important because u would get ur gc that much earlier compared to 2005-07 people. Just because ppl are able to file 485 does not mean that they are going to take a number out of the quota for that year. The numbers are only taken during approval and hence they would all still be stuck in the same queue and you would have gotten an oppurtunity to file and possible get your GC too...take a deep breath, relax and think about this with a cool mind. I definitely do feel bad for you. My labor was stuck in BEC too and i left my company and joined a new one and restarted all over again. Been on H1 for seven years without ever getting any chance to file 485 until now...

But still the good news is everyone would be able to get their EADs and escape from the clutches of H-1B renewals and restrictions of remaining with the same employer etc. It's freedom to work anywhere! Doesn't matter when actually the I485 gets approved, until then you're free of H-1B tension at least. This is a big leap forward.

Good News indeed, but to be frank it just doesn�t excite me even a bit. After being stuck for over five years and getting nothing at the end, I reserve the right for myself to be skeptical and pessimistic!! :-( --Sorry
There are certainly anti-immigration groups like IEEE/US and others who will use every weapon at their disposal to sabotage legislations like SKIL BILL etc., but the reality is that US economy is increasingly becoming dependent on foreign-born skilled workers and by gradual exit of baby-boom generation out of economy this trend will accelerate.
I hope Congressman Senssenbrener doesn�t dismiss the legislation. It is just unfair to link the immigration issues of Merit-Based Immigration Applicants to border security.
Please let us know what we could do to help the process.

Well, if your travel agent offers a Air France ticket, refuse and tell him the reason why u don't want to fly them.
First of all their tickets are way too pricy. People pay shit load of money and get treated like a dogs?? We have choice no matter where u fly from. Try to avoid these European carriers. Try to fly Asian or Indian carriers.
Air France needs to learn that everybody is a customer, irrespective of their skin color/race. And every customer is entitled to same service as rest of them.

In 2004, a friend moved within the same Multinational company (A) from one business (A1) to another (A2). The HR department did not apply for an H1 transfer assuming that one was not needed, and the friend worked for a few months before the business A2 was sold off, and the new company realized the mistake, and filed for her H1 transfer, which was approved. The new company then filed for her labor and got her I-140 approved.
Can the friend now file for AOS? Was the period that she worked for A2 'unauthorized'? Does that preclude her from adjusting her status now?

And i remember most of the people are sending letters only to President not a copy to IV.

Between my side i sent letter to president and requested 10 of my friends to do so..

when meetings take place on such issues, it's important to carry the large number of petition letters along...it has an important impact.
please do mail copies to iv also- can put them all in one envelope and send.
i have about 30 letters with me now (including 6 from another MN chapter members), many more are still in the works and i have friends working on it too...
