My friend, you have not seen the complete posting. I mentioned around 15 times that my lawyer has filed G-28 and AC21 together in May this year.
My lawyer is one of the best in southern California and i am with him since joining new company. He is going to check with TSC for G-28 and if they didn't updated one then i will have no choice but to ask old lawyer to forward the notice to me.
Sorry I missed that part. As you lawyer side is already taken care of, then I guess I would do the same that you have been thinking of doing. Take an infopass appointment, try to get a copy of the denial notice and also check if they have the updated G-28 in your file. By the mean time, let your lawyer do whatever he possibly can.
Also, as a professional courtesy, your lawyer should provide everything to the new lawyer once requested. Hopefully, the old lawyer will maintain the courtesy and won't cause any trouble.
Please keep us posted and good luck.

There you go. Here is the link for the opinion letter

Read it, Understand it and then please let me know if you still think that OP was in "unauthorized work", as this is what you have written before
Good work! Now, it is gapala's turn to read and understand and come back with the opinion or disagreement.

I am surprised that two of the biggest immigration law firms in the DC area have not been mentioned.
Wonder why?

I guess the cat is out of the bag. Yes, I got my greencard a few weeks ago. Yes, my PD is early 2004.
There are 2 current theories why:-
1. I'm very vocal in the media and lawmakers about the problem, and something made this happen (as my co-workers say "they gave it to you to shut you up")
2. I was a lucky one that was assigned a visa number in early June (when I applied for AOS) - it was approved when my PD was not current.
I'm not going anywhere, nothing has changed with the current policy. It is still broken. If for no other reason, the bizarre circumstances around my GC highlight more unpredictability and uncertainty in the whole process. I hadn't mentioned it before since it really isn't a big deal in the big picture.
Congrats.. and good to know that inspite of getting GC you have decided to stick with non-GC holders like us...
Thanks for your great efforts.

Does any one know how much IV collets in recurring contributions? How much did we collect for the DC rally and how much did we spend?

Hi All,
Thank you for the overwhelming response. I did skim through the responses and agree with most of the suggestions/comments if not all.
Someone had brought the issue of FIFO and if there is anything in the law that states that FIFO has to be followed. I am not a law expert myself and cannot comment on if there is any such law. But what I am basing is more on the everyday commensense behaviour that all we humans follow for any queue. FIFO is the predominant thing being done for any queue and that will be the most resonable way to process be it a bunch of applicantions waiting on a queue or to service a number of people waiting on a queue in a bank or post office or whereever it might be. That is the fair, unbiased and non-preferential way of doing things. Isn't it?
I want to make sure to convey the point that I first of all wanted to bring this issue to everyone's attention. May be my message was worded strongly, but doesn't mean that I am not flexible.
I thought suing DOL is one of the options. Of course if there are other viable alternatives that will be less demanding, less expensive and will take a more non-confronting approach but still could have an equal impact in terms of resolving the issue amicably then I am all for it. But then the obvious question is what are the other equally good options? Someone mentioned about a petition. So what is a petition and how do we do it? Also mentioned was writing letters to congressmen etc. So who do we contact and how? Please, please anyone having the information please share.
One more thing is that I am all for a dialog with IV core members and their guidance for this. Since I started this thread doesn't mean that I wanted to sideline IVs, but this is the only way I thought I could communicate to the IV platform about the agony of this issue and how people have been affected by this. So I am all for talking with IV core members on this. But please let me know how I could do that?
So please let us start acting now: The list of next possible steps (in no particular order) are:
- Decide if there are viable alternatives to a lawsuit that is more non-confronting and first try them if possible
- Get the support of IV core team for this
- If no other alternatives are available then consider filing a case. Consult an attorney for this
- Raise more awareness about this and get allt he support we can
- Raise some money towards this cause
So please please provide more inputs so that we could start making some real progress. Thanks!!
Hello Risker,
After going through all postings, it is wise to consider the following actions in order:
1. Contact the IV core team and tell our problem. Ask their input about what we can do and whom we need to contact. They may let us in correct direction.
2. In the meantime, Get the details of peoples whose case are still in backlog centre.
3. Finally, nothing works and no one help us, file a lawsuit. (As I dont know anything about the lawsuit here, many of them mentioned that the lawsuit should be done by the employer and there is more possibility of loosing.. We should not lose heart on that. In the suit, we need to ask them to make it current and keep the same filing fees until 30 Sep 07)
P.S. As one of the posting mentioned, we may also consider waiting till Sep 07 before filing lawsuit. Because DOL promised to clear all cases before 30 Sep 07. If they dont then our case become more stronger. Till then we need to contact concerned people (like IV, congressman etc) and collect all infromation.

Guys,
I don't know why you are wasting your time calling uscis. The fact is that USCIS released a statement they would reject all applications. Please don't waste your valuable time and focus of media and your senators. Please don't count on miracles. For now uscis may hold the applications for a few days because of the congressional action by congresswoman Lofgran, but we should keep the momentum and increase the awareness of this important issue.
Contact you senators and the press like others did! Thank You.

Agree with you 100%. Instead of 'forming' state chapters in the last moment, they need to be established, nourished, strengthened and developed over a period of time. A grassroots movement needs strong roots in all regions.
With all due respect, it was a disaster. They ended up scaring Americans - by holding Flags of thier countries, holding US flag upside-down or disrespecting US flag in other ways. This provided fodder to anti-immigrants to scare Americans of an 'invasion' of law-breaking aliens.
We need to learn lessons from them, in not committing their mistakes
As of now, idea doesn't look good. 10 people marching in Detroit, 20 in Minneapolis, 40 in New York, 100 in California - will it even be a rally, in the true sense?

Do you really think the numbers will be that bad? Look at the improvement in turnout in DC from San Jose? Every movement political or not builds gradually. The idea is to make it easy for people to show up rather than ridicule them for not showing up.
We asked people to show up at the rally giving up (1) A days pay ($400 to 1000) (2) Spend money on travel where ever the buses were not available ($$) (3) Spend time away from home. Thats a little difficult for people who have not seen a single person from IV yet (which is most of us). On the other hand many people who attended the rally in San Jose did not mind traveling all the way to DCCan you think why? Do you think Indians in CA have a different mindset compared to those in TX or NY/NJ?
IMHO, we need to do more work at grass root level. If rallies are local and on a weekend then more people will turn out. Not only will there be better turnout, many of these same people will being more passionate about their support to IV and might start showing up in out of state rallies and protests.
Many of my colleagues did not even know until yesterday when I showed then the news articles that there was a rally like this in DC. Unless we have local chapters with an organized structure which meet regularly/ even if its a conference call, you cannot expect mass mobilizationthis is Politics works!!
I think the DC rally has caught every ones attention, this is the right time to push the drive for local mobilization, it will be tragic if we lose the momentum now.

How about having a monthy/semi monthly conf call (similar to Rajiv Khanna's call), that will probably help in making every one aware of the structure and heirarchy in IV. I am sure a lot of us want to do some thing...posting 100 times to get noticed can't really be the best way to manage the ideas.
I got a feeling that some members feel that IV run a secret community with-in IV (I am not sure how many watched the movie "The Stepford Wives" ).
I think that core members and volunters knows strategy and action plan well before others. I think there would be hierarchy within that also.
I dont see anything wrong in that.
Here I think what goes on internally.. If you are more active in the threads you would sure get a message from IV moderators about ur willingness to volunteer. IV core seriously does not have the ability to read the psyches of each individaul member and invite them int to the secret soceity(?). Only possible way to know for them is how much active you are for a while. i dont think there are any specific paramters for that , it is a matter IV core getting convinced that u r serious enough. Not a day or two.. How long .. and how serious you are with ur ideas...
About funds .. none of the organizations declare their monetory dealings openly. There is a youtube video by logiclife on this. see it if u have not laready seen it.
Keep up the good work.. Sure you would become the member of secret soceity soon :).
I read sometime back nixtor became IV core member recently..

Hi NK2006,
I am afraid my analysis reflect the reality. I have heard a number of people talking about this and polls have shown that is the case. Iraq war & scandals were the driving force behind this. Nothing else. Even liberal newspapers such as The Nation report that is the case:
http://www.thenation.com/blogs/capitalgames?pid=137918
Americans are really disappointed with the GOP in general and I personally know a leader of an anti-illegal alien group who voted against his Republican representative. That is true. It is odd, but that is the truth.
Regards,
Ombudsman
So your analysis is: people are unhappy with GOP that “some” of them are in favor of immigration measures and punished them by giving control to a party where “most” of them are certain to support those same measures ????!!!???!!! Its most illogical and even comical analysis I ever heard.
Elections show that American people are much smarter than some politicians/talk show/TV show hosts hoped for. True, elections are fought on much stronger issues like war, economy etc and exit polls have shows that people are not too concerned about illegal immigration issue despite of coverage given by likes of Lou Dobbs. Also based on the fate of candidates who made the immigration their main plank, it can be argued that majority is actually in favor of such measures…..election results are a lot complicated to say anything like that…..but….its a much more logical conclusion that what you were saying.

I am guessing the presumption behind logiclife's post is that we're all responsible, thinking and educated adults who shouldn't have to be begged and pleaded with to behave with decency or show some common courtesies at the least. If IV was formed a few months ago, then it's understandable tho not excusable that people who have legitimate ead/ap concerns just talk about it on the forum and then leave. But if someone's been around for more than a year and still has not participated in a meeting or contributed in other ways its truly pathetic. Even tho I dont track every piece of news on immigration, I consider myself fairly well informed and day by day the outlook only gets scarier. Today at lunch, we were talking about junk forwards and poking fun at those who send them and a friend mentioned how he has been getting so many fwds with anti-immigrant messages these days(my friends are obviously pro-legals, somewhat ambivalent about illegals but not the lou audience type & dont lose sleep over a bunch of poor busboys/gardeners crossing the border). This anti movement is growing powerful by the day with clear agendas and goals but theres no countervailing pro-movement to speak of except iv, only sympathisers. Yesterday Lou was on tv promoting his book to princeton club in new york. After Lou had chewed off on the illegals in response to a question, another member conveniently queried him on what he thought of the top end of the immigration spectrum worked. After labelling H1b a disaster(in other words people like us are here in the US because of a broken program) he sought to portray congressional hearings as some farce as apparently only Bill Gates was invited to speak this year. He ofcourse didnt mention that orgs like CIS, numbersusa and others were invited last year when his friends like Tancredo were running congress, orgs that would be labelled as hate groups in normal times in the halls of congress helping set policy! And then he said that 75% of H1bs goto Indians in the US who work for Indian companies domociled here to just to outsource American jobs. Not only did he make a chillingly racist assertion based on a complete lie, he was implicitly advocating shutting down the only legal avenue to immigrate for people like us who didn't win a genetic lottery and were born into the right family! This, in New york of all places and that too at Princeton club after dissing about 'elites' and how 'acquiescent' some were!! Voicing some legitimate concerns of the common man along with radical or divisive agendas are nothing new but he's taking it to new levels. That's why as someone else already said elsewheer, iv shld be more than a bulletin board to discuss legitimate ead/ap concerns- its the only openly pro-immigrant(EB)movement. There are a few opinion journalists penning a piece here & there but that doesn't help much. Some of us are in cozy well paying jobs who are certain to get gc's and can wait however long it takes but thats no reason to sitby and let others who are not so certain about their future struggle alone. And finally, we all have been yelled at and its not the end of the world so getover it dontr be such friggin crybabies!

Hope your ideas or similar ones work. But seriously.. if someone isnt contributing 50/100 bucks, will he/she be willing to get IV credit cards.
From my experience I would like to say contribution is simple. Hard part for me was to convince myself that this was right thing to do. I dont think it will be about monitory constraints for most of us.
While we are brainstorming constructive ideas, I would like to suggest some fund raising ideas. ( I have posted this kind of ideas earlier but no solid response.)
Instead of strictly relying on funding drives IV should consider alternative source of funding.
Here are two most simple ideas
1) Start showing Google ads on IV website. I am happy to see click on ads and generate some fund for IV
2) IV branded credit card, its very simple Chase/BOA will be happy to sponsor IV credit card and pay 2% back monthly to IV if they can sign up 20,000 new customers.
Keep asking for donating fund hits wall everytime, its time to work on alternative ideas.

Still your end in mind is US. Ok when I have a job in US and waiting in retrogression, what is the adavantage of having canadian PR and moving there unless otherwise you get a jump in career.
Just becos it is retrogressed and you have canadina PR, there is no advantage in moving to Canada.
I have an EB3 app from Oct 02. One more PERM filed 2 months back. My wife has an approved EB3 140 waiting to file 485.
We have canadian PR cards. We have decided to move to Canada in Oct. We may come back here once numbers are available to file for 485 or im thinking of becoming a canadian citizen. who knows t'row some bright guy in Congress may create a rule saying Canadian citizens are exempt from visa numbers :)

Assuming no relief for immigration system as a whole, EB3 India will move forward substantially only during last quarter of the FY.
Rest of the times, it will be in 2001 or 1999 or even pre-immigration years. You never know.
The least preferred category among EB (taking the country tab in to account) is EB3 - India.
Isn't that a privilege to us?

Is there any update on administrative fix for filing the adjustment of status (485) without priority date being current. As this will be an important measure as well for those who miss the oppurtunity last year.
This fix would help definately relieve stress for our better half as well......

On a lighter note....the red marks alonside ur IV user profile...they indicate the number of feathers in ur hat---i got more red ones than anyone here..which means i may soon be in IV hall of fame ....once u end up there n still miss ur buddies here on IV forum...u gotta reboot ur modem n sign up again with a diff username... not as diff as an ead renewal:-)
take it easy---u r off the hook for 1 yr now!!!
You are right that it is a long wait...for me ten years is almost coming, but no relief yet. I hate to get these documents renewed every year. It is a vicious cycle whole year round to update one or the other document in different points of time. It is becoming a nightmare when we could do something useful instead.
And yes you are very right that I am responsible for my own choice, but after spending 10 years of my prime life and youth I think there are vey few options otherwise. More importantly when you have kids grown up and more assimilated here. You don't want to force your will on them. I hope you understand what I mean.
BTW, I am surprised that people have given me red dots from behind. Talk to me directly if you think I am wrong.

I too had very bad experience with Air India, the aircrafts are in bad shape, very poor customer service. I stopped taking Air India after couple of bad experience. I take Jet Airways now, they are pretty good, friendly hostess and good customer service.
