The good news is that after twenty years of inaction and demagogy, the US Senate is considering sweeping immigration reform. Behind that effort is a bipartisan consensus that grew out of a confluence of disparate factors: On the right, American business, desperate for low-wage and unskilled service workers, was clamoring to legalize the immigrant labor market; on the left, organized labor and liberals wanted an end to the illegal status of so many workers. And the sheer number of illegals now living in the United States--three times as many as a decade ago--demanded that something be done.
The bad news is that after arduously fighting its way to the top of the national legislative agenda--Senate majority leader Bill Frist fixed March 27 as the deadline for the Senate to come up with a bill--reform now threatens to be dead on arrival. Intransigence by the Republican right and a failure of nerve by Bush may have doomed a tenuous, years-long push to rewrite a current policy mired in denial and hypocrisy. "We may be on the verge of seeing the Republicans do to immigration what Hillary Clinton did to healthcare in the 1990s," said a prominent immigration attorney. "Set it back several decades."

No one is willing to guess what will come out of the Senate process, no less out of any conference measure that would have to bridge the gap between the Senate and the draconian Sensenbrenner bill, already approved by the House. And if the process drags on closer to the November elections, chances for significant reform will dim considerably. Republicans, and especially the President, will be reluctant to further aggravate their internal party divisions. And even if Bush regains his confidence in pushing for reform, will Democrats--with their eyes now set on winning in November--really be ready to line up behind him?

You definitely raise an interesting case. What I would say to that is that they just have to reevaluate the points allocation system. the details of the point allocation system may be bad but the overall intent still stands to benefit the highly educated while including the EB system as well will make sure less skilled but in demand people are also taken care off. handling family based GC is a whole diff ball game though.

The total bill was written by special interest groups on both sides of the political aisle.
 
I agree that a strong economy like america needs both skilled and unskilled people. Shouldn't it be left to the employer to find out who is the best person that can do the job.
 
The bill as it was written before the cloture vote was a piece of CXXX.
 
Once the bill is passed I dont think anyone wants to talk about immigration for another 20 years , I dont think I want to wait for another 20 years for law makers to make changes to the point system.
 
I am happy that this ill conceived bill is on life support system now. Hope they are not able to revive it ...

If they are going to work in US, then consulates will ask "super technical" questions at the H4s, like "Who will be your client?, Show us the contract!" etc.

sagar_nyc, agreed. EB3 is a joke and even worst I have become a joker in front of all my friends who applied in EB2 cheating the system. Funny is, experience wise, I am well ahead of all those making fun of me but...:-(
 
too bad, eb3 does not even have a place to vent these days as IV forums and its thread only has discussions from EB2 members.
 
anyway, best of luck to everybody. the world is not fair, I am willing to fight my part to make it fair and just for all.

I talked to many representatives regarding my I 140 filing from yesterday.
 
This is what all msot all of them said.
 
Nebraska center is running behind with their schedule in generating their receipt numbers.
 
First all the applications go to the mail room. If everything looks fine with the application, the mail room people would send the cheques to be enchased. This normally takes like a day or 2. Then they send the applications to a different department where the clerk needs to put the information in the system and generate the reciept and mail it out. All this process should normally take, 5 to 7 days and Nebraska Center has a turn around time of 15 days.
 
But Nebraska center is backlogged a bit due to the numerous applications they recieved, till last week for I 140's. And a decision was made yesterday that, the Nebraska Center would catch up generating all the receipts by August 1st. (Thats what the reps told me). So everyone's receipt number who filed their I 140 by July 16th should be available in the system by August 1st(we wud complete the 15 days turn around time too). And if they get mailed out by then, we may recieve in a week or so, by Aug 10th.
 
So everyone will be good to go. Even if you dont get the receipt, your checks would be enchashed by then which will have a receipt number and you can call the USCIS office to confirm that receipt number (as they will have it in their system by August 1st) and just file by putting the copies of those checks.
 
Its not our problem that they delay the receipts.
 
But I hope that everyone will get their receipts by August 10th. So just chill out and relax.

It creates a parallel merit-based employer sponsored category without touching the existing merit-based self-sponsored category.
 
The merit based self-sponsored category is the crappy points system. This is in parallel to that, without touching anything in points system. They have created an exact parallel replica of today's EB1, EB2 and EB3 system with labor certification and the whole enchilada where you need employer sponsor and there is not points or anything.
 
EB1 = 33.3%, EB2 = 33.3% and EB3 = 33.3%. Definiation of EB1, EB2 and EB3 would be the same as it is today.
Total quota of 140,000 with automatic recapture of previous years unused GCs.
Exemptions for US masters and non-US STEM masters with have 3 years experience in that STEM field.The risk factor:
 
Now, the bad part ... the achilles heel of every high-skills amendment is the tethered H1B quota tricks. They are exempting everyone who has US masters or a non-US master in STEM from H1 quota, effectively making H1 quota = A LOT MORE.
 
The exact same radioactive provision for H1 quota is also in Lieberman-Hagel amendment 1242.
 
This will sink both of them unless either there is some inside deal going on that we dont know, or they strike out the H1 issue from this on the floor of the senate at the last minute and be content with H1 quota of 180,000.

First of all I think logiclife will go in the history of immigration books as the movers that existed in this generation. I am amazed at how motivated the IV core team is and how smoothly they have organized the whole show so far. 
 
I salute you. Hats off to you guys.
 
I read a lot of newspaper articles after the rally and they always seemed to mention that Indian and Chinese legal aliens protesting backlogs. I think there should be some effort to also include people from other nationalities such as Russians, Englishmen, Philipinos, Chinese and other nationalities. Now I know they are not hit as hard as us but they go thru some serious backlog as well if they are in the EB3 category.
 
Question is I am thinking how?

Where did the 50K visas come from? Where will the 90K visas come from?
 
Are they from the total pool of 144K/year or is this an additional amount (144K + 90K) allocated for health care?

I would recommend shusterman.com -- one of their lawyers Ms Najfabadi is extremely efficient, fast. Overall this lawfirm is very influential (with uscis, dos, senate, etc) and will help you out if you get stuck somewhere in the process and will get u out of trouble by hook or crook (upto the extent the law permits).
