    My employer did not even bother When i talked about this. They are happy with just recruiting desperate and non desperate H1bs. Many of us are addicted to the US. We will not leave despite any indignity or humiliation. You have a weakness and it will be used. Way of life.

    So let us continue to be indentured for many years. What never ceases to maze me is despite so much work by IV, big employers, faxes, emails the govt has done nothing. Seriously, there is a bigger issue here. See how they acted to get more nurses ? That is not happening here.I think all concerned are sure, EB guys will sit out even if it takes 10 more years. So , let us sit it out, bcos it seems like we aint got no place to go. Right ?

    This guy's a congenital pessimist.

    H-1B numbers did go up. Now also the numbers are going up to 115,000 and then 180,000. It is only GC numbers which are going down and down.

    Now when explained like this anyone would understand. Also do see the point you are making and is worth a try. Is the core team looking into this? Do they need any assitance from us?

    Some are good, but some are hard nuts, they take immigrants for granted. A lot of silent suferers constantly remain silent and crib about these Attorneys because they cannot move out of their companies and have to depend on them.

    Some may not understand things in a good way

    To be frank there was momemtum and energy missing in DC and other states before the rally! I think there are many ignorant, many not willing and many not up to giving a day!
    Have we tried to educate them about their situation today ..
    IF many of us have been able to file I485 in JULY then its 'coz of IV and ONLY IV!!
    If we stress on IV's acheivements .. eg. flower campaign & San jose Rally and outcome of these..Reversal of Visa Bulletin then I think people will try to understand..
    Tell you what people with PD in the last 2 yrs have not shown up in big numbers! Only with PD as late as 2001,02,03,04,05 have been able to evaluate the seriuosness of the whole GC thing & able to visualise the waiting frustrations!! Lets bring in more of the recent yrs PD people so that they know HOW LUCKY they are Just 'coz of IV!!


    I think most of PD's with 05, 06, 07 got a chance to apply I-485 and may be they thought tht they got their GC by applying I-485. They are happy for tht and didnt really understand the seriousness of the situation. This is just my thought. [No offense on all ppl who attended the rally with PD 05, 06, 07]

    Yes, I agree...we need some sort of intelligent Non -Cooperation Movement...
    But I am afraid when we cannot stand united on this group- with only 200-400 or so of the 9000 contributing, I am not even sure what kind of Non Cooperation will work here.
    We need to get United,,, that is the need of the hour..

    I work for a big company in the SV and I know at least 100+ Indians and Chinese there, but when I showed up in the San Jose rally I didn't see any of them.

    That hurts to see so many people using IV for tracking receipts on the day of the rally but not participating in the struggle IV is putting up just for them!!
    But know what I think as members we have really considered all of them as one..! I mean.. we should have given special attention to DC and the neighbouring states to fetch in max people.. 'coz we can depend on them for proximity..! we have majorly focussed on getting people from various states..well that again paid off .. 'coz news articles particularly mentioned people flew in from states as far as CA etc..

    We cannot consider a person from texas or seattle to be the same as one in DC / VA .. Its definitely hard to convince to attend a rally .. how can we convince to take a day/2 off and travel leaving family and rest !!
    Its sounds good and practical for some but many others will not concur!
    I think we learn from our doings...! we should next time try and rope in as many locals as possible than depend on people coming from afar!

    I dont think it is 9,800 each. I think it is 9,800 combined - 7% of 140K. To that extent the 21500 number in my earlier post stands revised down to 17,700.

    Your interpretation is incorrect. An advanced degree holder from the US will not need labor certification. Please go through my and Appu's reasoning in earlier posts on this thread to understand why.

    Per Frist's bill, an advanced degree holder in STEM with 3 years experience will be subject to special handling in labor cert. Your (iii) refers to this person. This person is not subject to the numerical quota.

    An advanced STEM degree holder from the US does not need labor cert. This is because notwithstanding the applicant's admissiblity for permanent residence, the applicant can file for adjustment of status as long as he has an immigrant petition. "Applicant's admissibility for permanent residency" refers to labor cert for EB 2/3 workers - see section 212 of INA. So irrespective of labor cert, the advanced STEM degree holder from the US can file for Adjustment of Status and I140. However, this person is subject to numerical quota and has to wait for a green card number for 485 approval.

    Put both the above paragraphs together - the advanced STEM degree holder from the US with 3 years experience has the best of both worlds - no labor cert, no quota, can file for I140 and I48.

    To answer your question Yes nuthing gets transfered. Every time its a new h1b there is no transfer of anything. You can have 2 or more valid approved petition from different employers but you can use only one at a time.

    Pay - They are liable and USCIS can question them. All they will have to do is show that this employee (OP) was no show never joined the company so basically agree with you here.

    I was also under the same assumption. But I came to know that you can work for more than one sponsoring employer at a time.

    I understand your friends marriage is important and you can't miss it at any cost.

    I'm hoping that since you anyways plan to be in Troy that day, you can try to attend for 15 minutes-30 minutes and then leave for your friends ceremony. I don't think the meeting will be a whole day afair. It might last half an hour to an hour max. Please consider the possibility of partial attendance, if possible, while attending your friends marriage - as every extra member attending the meet is a moralebooster to the rest of us.

    It would be great if we can have you there, even if it's just for a few minutes. (You can call one of us later for more details)


    I am very sorry but I will not be able to make it on the 20th. I was informed by my Indian friend that he will get married on the same day at Troy too. Talking about coincidence. Anyway, I wish the Michigan Chapter meeting will be successful.

    Good to hear some good and not so good reviews about the immigration lawyers in this thread. One of the firms about which folks have written contradictory statements is Fragomen. Thay have been very responsive and professional in some cases but the user polulation in general has complained about their non responsiveness. They have advised their clients ( i.e the companies) about how the slow down the process for green cards for their employees. It has been seen in a multitude of cases that they have advised the companies of not filing for EB-2 cases and use the route that creates the most delays in GC processing thus maximing the revenues for themselves and helping the companies use GC processing as a tool for employee retention. They made employers to belive that letting the cases processed in BEC is the best option instead of capturing the PD's from the old cases to PERM. Now, several thousand of those cases are still languishing at BEC and no one seems to have an answer about what will happen to those after 17th August.Isn't that so so unfair......

    Their practice can not be termed ethical and the employees need to highlight this issue with their senior management and HR. I was wondering if Immigration Voice can help those individuals by guiding them about appropriate steps to highlight the malpractice by Fragomen.
