I know you have been correct in the past but I think we have just gotten over the hump of 2003 and a small portion of 2004 for EB2. The majority of 2004 and early 2005 still remains. There was a huge jump in March 2005 to beat PERM. I dont understand how it will reach 2007
Here are all the LC approvals for India in the last seven years.

You can sign on on behalf of your son and you can place (father/mother) next to it.. This won't need a G28 form.
I am preparing I131 (AP) renewal application for me and my family. For my son, who is 8 years old, do I need to fill "Part 9. Signature of Person preparing the form, if other than the applicant" since I am preparing this form? OR can I just sign Part 8 on-behalf of my son?

I believe it is very practical and if it is included in SKIL bill I do not see any opposition coming in senate or house just on this point. L1 spouses were not allowed to work till few years back congress amended it and allowed them to work. Same is very much possible for H4 also.
Those of you who do not agree remeber L2 were also dependednt few years back and are still dependents but they were allowed to work few years back by Congress.

I am in EB2 ADP with PD Feb'09. No cheating there ! :)
I understand that if a lot of EB3 guys, who have been waiting for years, start porting to EB2, they will end up in the queue before me :(. And with that knowledge, I will still support EB3-EB2 porting.
EB3 guys, porting is your best option. I hear a lot of EB2 asking you to go get a new job where they are willing to
a. Hire you with your H1B status,
b. Agree to file your GC, and
c. Agree to do it in EB2 category. (Think about the min wage they have to give and prove etc.)
It is way easier said than done in the current economy. But if you find one, go for it. That is a way of respite for you folks. For others, try porting to EB2 with your current company.
There have been cases where EB3 was filed when the candidate was eligible for EB2 and there have been cases other way round too. But talking about none of them helps your cause. Similarly, fighting amongst us doesn't help either. Don't get me wrong if I say that with EB2 movement, if EB2 becomes current by the end of next year, EB3 will start seeing a good benefit of spill overs. So with current laws, getting EB2 out of the way will actually help your cause
Eliminating per country limit will help everyone. We should fight for that, EB3 and EB2 together.
Seriously try for porting. I have been waiting just a year, and already know how many decisions get put on hold because of this process.

I got the email "card sent for production" yesterday... EAD was applied last week of May!
My Guess... they probably got a MEMO to drop everything and approve all EAD apps before June 30th :rolleyes:

This is certainly good news for many. However the skeptic in me is feeling very uneasy. Why did they suddenly open the flood gates? Did they purposely create a backlog and then increase the fees (double the fees) just in time? Are we going to face other issues down the line after applying for 485?
I guess for now, we will just celebrate and try to get our 485 applications in before July 31st. After that it is a wait and watch situation.

Ok, As promised I am giving you an update I contacted my attorneys office yesterday the most senior attorney was out so I spoke to her assistant and according to him, If USCIS made a mistake then its their mistake not mine once the GC card comes enjoy it and if they realized they made a mistake 3 years from now or 5 years from now well by that time my PD would probably be current so whats the difference. He did recommend I wait longer than 5 years to apply for citizenship buts thats a long way ahead. It just might be my 4th of July gift. :) I will keep you all updated on any changes.

Hi,
My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?
- My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?
- Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?

That hurts to see so many people using IV for tracking receipts on the day of the rally but not participating in the struggle IV is putting up just for them!!
But know what I think as members we have really considered all of them as one..! I mean.. we should have given special attention to DC and the neighbouring states to fetch in max people.. 'coz we can depend on them for proximity..! we have majorly focussed on getting people from various states..well that again paid off .. 'coz news articles particularly mentioned people flew in from states as far as CA etc..
We cannot consider a person from texas or seattle to be the same as one in DC / VA .. Its definitely hard to convince to attend a rally .. how can we convince to take a day/2 off and travel leaving family and rest !!

Here's what they got that we don't
1) Numbers - 12 million new voters indebted to them for life, is too hard for some national-level politicians to resist
- We are barely 1 million. Given we are "highly-skilled" most of us never likely to vote in elections (to avoid jury duties)
2) Strong support from US Citizens who vote for ethnic reasons. Whether anyone likes it or not legalization of "undocumented" has become a ethnic issue. More powerful than our international/global approach, because there are 25% of US population belong to that ethnicity ( and they also vote in greater percentages than the natives)
- Chinese/Indian/Phillipino/others USC/LPRs communities are miniscule in number. And most of them don't give a you-know-what.
3) They have the strongest Motivator - FEAR - it's a matter of 'survival' and not just pursuit of happiness like us. God forbid, we go back to our countries we won't starve there. These guys don't have any jobs in their countries and will be living in abject poverty . They risk death in the desert, whenever they go for vacation back home. Cops, criminals, USCIS, abusive Employers, Nativists - everyones at their back. Some of them are married to US citizens/LPRs. They face the prospects of getting separated from their families.
- We don't have such a strong motivation. If let's say there was a NumbersUSA sponsored bill to bring all legal immigration down to 50,000, believe me, DC would've been swamped by protesters. We may have met, even exceed initial projection of 10,000 participants. You'd have seen a true multi-ethnic protest respresented by every nation on the Atlas.
4) Money is not a problem for them. Many of them are paid off the books and have never paid Income Tax, SS Tax etc. There are also very strong political organizations, PACs (Political Action Committees) supporting. There are many USCs/LPRs contributing to election campaigns on their behalf.
- We pay all taxes. There is no PAC supporting the cause of EB immigrants exclusively ( ImmigrantsList is a PAC that supports all immigration including "undocumented").
Unless a LPR starts a PAC ( Aman?) starts collecting funds from other former-IV LPRs and US citizens and starts campaign contributions we continue to have a limited voice ( paying a Congressmans election campaign is will catch his/her attention more than paying a lobbyist to talk to them)
So it's not them having many negatives. It's us EB immigrants who face the strongest odds.
Just an analogy please dont think i am against undocumented fellows.. They are definitely facing a bigger problem than us!
Compare the following
Nondocumented vs. Documented Legals
1] Not well educated / Highly Skilled
2] Not much computer savvy / Mostly everyone should be
3] Not have enough resources to advertise their struggle!
/ Trying all ways to advertise & campaign
4] Do not have enough monetary collection to run a rally / advt /
set up a website
/ Have some collection to do the basics
5] Come here illegally and yet have the courage to demand a legal status openly...
/ Feel shy or sorry for demanding a legal status soon! (for those who dont think
this is worthwhile)
Inspite of all these negatives , they have grouped up so well ! highly commendable. I dont know what we can learn from them, only that they are all in the same boat , but we are in different ones .. as some have got gc, some have got receipts, some are ready to wait as they have just applied, some are just not interested!!
