You are certainly entitled to your interpretation and Mr. Gotcher is entitled to his but I wouldn't go as far as calling it a ploy to increase more traffic. I am not sure if you are an attorney but he is and he certainly has more understanding of immigration law than most of us here. As with any law and immigration in particular, there is room left for interpretation and Mr. Gotcher is simply stating his point of view. I hate to say this and I hope I am wrong. All of us EB3 folks need to start speaking up or else our fate is sealed. I do not see any hopes of CIR passing. There is always going to be some political backlash due to the AMNESTY factor.
From what I have seen, most employers are now filing only in EB2 category. They know that filing in EB3 will see their applicants backlogged so severly that there is no hope in seeing their applications approved. So, even those with less than 5 years of experience create resumes that show 5 years to qualify for EB2. Imagine the flood of applicants in EB2 that will pour in when the dates move forward beyond July 2007. There will be a new backlog of EB2 numbers that we have to wait behind. When are we going to get our turn?
With nearly 10 years of experience and a master's degree, I am still languishing behind all these new comers who come here with fake experiences to qualify for EB2.
We EB3 folks need to speak up, and have the spill over given to the oldest filed applications IRRESPECTIVE of category. The spillover rules from what I know were defined at a later stage and not as per the original law. If we cannot get CIR passed nor a piecemeal regulation, at least let us get the spillover changed.
Or, let us en masse transfer to EB2 by porting, thereby making us all eligible for GC ahead of those that are coming in through the back door. I see them as no different from the undocumented immigrants. Breaking the ethical law at the expense of those of us who followed the law. Our positions did not require a Master's degree and I dont see why a programming position today still requires such. I also dont see why our experience today should not count towards qualifying for EB2.

I wonder why nobody takes up the cause for H4 visa holders who are mostly women and who becomes completely dependant on their husbands once they enter this country .With retrogression and the endless wait for GC it means losing all the skill sets that you have and all the opportunites that come along just because you donot have a EAD card. Worst of all nobody who speaks so much about womens emancipation seems to care.

My last and final update to this post. I got my original Green Card (Cards not green color) It was the happiest day, the wait was finally over the air smelled a little better.
My two cents - Have patience explore other means of getting green card if one doesn't work. An attorney once told me there are soo many ways and regulationsto get green card that half of them are not even in law manuals only the old timers know about them. Enjoy life life with green card and with out it is the same.but the time you spend never comes back. If you have problems with your employer just imagine if you didn't have a job. So make the best of your time and enjoy this great land which we call america.

I think very few people will disagree with the fact that EB2 I will retrogress in OCT. Reason for this is DOS always tends to take conservative approach to set the cutoff dates in the first and second quarters.

Do we even dare to hold the CIS/DOS accountable for their wishful manipulation of PDs? These guys can't even give us information that's there in their own systems.
Did we raise our voice when H1Bs (an arch which all of us have passed through) were being demonized by the media and politicians?
So we are not holding the people who have been the biggest beneficiaries of our money accountable, why hold a volunteer group, who are nothing more than regular people like us with families and personal issues accountable for trying to fix something that's broken.
Shoot in the city I live in, it's like the Richard Pryor paraphrase "I see brown people"
Yet when we want to discuss agenda and action items, how many show up: 6, yes, 6.
Maybe next time we'll put up a board for free pizza and beer.

Hi guys,
This is what my lawyer said.
If you/spouse have used your EAD or are using your EAD then your "Current Immigration Status" is "Adjustment of Status Pending/Parolee". If not then it is either H1B or H4.
If you/spouse have actually travlled outside the US and re-entered using the Advanced parole, then your "Manner of Last Entry" is "Parolee". If not then it is what it says on your I-94 (H1B or H4).
You do **NOT** need the $80 Biometric fee for the Advanced Parole.

This is a different employer, so I am assuming it is new H1. If I remember correctly from my past research, H1 is always NEW when you file it with different employer, but I am not 100% sure....

It is New H1 with Transfer of I-94. It has been shortened into H1 Transfer to separate it from 65000 per year Quota.
If someone gets the H1 approval without I-94 they call it H1 is approved but transfer denied. They will have go out of the country and come back to get I-94.
When someone doing the Transfer they put it as new H1. Then they will say whether it is coming from yearly quota or not.
