Sorry - I can't currently access the report you quote your oringinal figures from at the beginning of your quote. Are these numbers of total immigration, or immigration in the highly skilled category?

Can you give us some more details about the call to get receipt number?
One of my friend called but they said they can only give I-140 Receipt no to employer.
I called USCIS today and they asked my name and date of birth and they gave me my Receipt Number for I-140.
My I-140 was recieved on July 16th and they generated a receipt notice and have sent me...I shud probably recieve it by this week.
Hope u all also get it soon...

You may be all right as far as your discussion is concerned but for the following one:
1000 people * $20 each = $20 K. So that is not an impossibility.
1000 people donating 20 bucks each, dude you are day dreaming. If you are seriously into this law suit stuff, be prepared to speand MONEY, TIME, ENERGY of your own and not 20$ from your side.
Did you not hear about how Aman spent 60+K of his own. So.....
I contributed around 300$ till now to IV.
I am one of the several may be thousand who have been affected. I am not using this for my slefish purposes. I am trying to get the suppoprt of IV and its members for this cause. I am not disagreeing with IV in any way.
This is an agenda for a common cause for all affected people and I want everyone to support.
Someone has to sow the seed and start the process. Doesn't mean since I started the thread it is my selfish agenda. It is part of IV's goal to get justice for all people who are affected by any immigration issue. So IV is the right forum to raise this issue.

We are not talking about what's beneficial to the United States. What we are discussing is what the law says. It doesn't matter if it is beneficial to the United States or not, if it is the law of the land then everyone has to abide by it; even the government. I think everyone has a different opinion on what's beneficial for this country. If you talk to the people at numbersusa.com, they will say that H1B program and employment based immigration is the worst thing that happened to this country and should be stopped right at this moment yet we think that this is the best thing for this country. Go figure.
By the way, you seem to suggest that everyone in ROW is unskilled professional. Nothing can be further from the truth. I don't know where you get your facts from but it sounds like you certainly need some help on that front.

When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher

Having an approved 140 and a 485 pending for more than six months is the safe method of switching. For AC21, the key is to have your 485 pending for more than six months. You can use AC21 to switch employers after six months of filing of 485 even if your 140 is not approved. Its not a simple process but folks have done it.

Everbody's posts here are speculations on what USCIS will do to I-485's filed on or after July 2. Everybody is trying to get an answer from USCIS. You called and got an answer DIRECTLY from USCIS which you doubt and don't believe. So what you want is for people here, who can only come up with speculations as to what USCIS's action would be, to confirm what USCIS already told you???

To me it looks like a ploy by Republicans:
1) To fracture the support for CIR and isolate the undocumented workers
2) Republicans already enjoy support of the anti-immigration lobbies, what better than to add legal immigrant lobbies to their support base. Contradictory, yes, but a suave political move to confuse voters further.
Strategically, when one doesn't enjoy clear majority support, this is a perfect political move.
3) If this were a betting game, I would put my money on,"Nothing is going to happen on SKIL till after the Nov. elections" horse.
4) If Democrats win the House in Nov. the SKIL will have trouble, because it is sponsored by Republicans. If Republicans retain the house, well, SKIL bill would have served its purpose.
5) Even if House passes the SKIL bill Senate won't pass it because they already passed a comprehensive bill. They won't want to appear to be partial to legals and overlook the undocumented workers.
These are my thoughts on SKIL bill as it stands today, I may be wrong.

It is 200% certain that the politicians will not touch the immigration topic in the next one year. Even after best efforts of the president the immigration bill failed in the senate few months ago.
One and only one thing that can be tried before Nov 2008 is the recapture of visa numbers from the last five years. I think IV should push for that.
Other than the above not much can happen, get ready for really long cold winter and then a looong hot summer. I wish things were better.

The Crux of the matter is 'Indians discriminate Indians !!!!'. You see that everyday.....
1.Indian embassies in US...
2.Air India service is better for Goras and Goris than us...
3.Even in a website called IV and the list goes on and on.
Its been long forgotten that we were once the richest country in the world with a amazing history and cultural background.
Bottom line: Once a fellow Indian starts respecting another fellow Indian 'others will follow'.

Are they going to redo the amendment process in S.1639 for the already agreed amendment through S.1348?
One change I noticed.
Now people can continue in the old system if the I-140 was approved or pending before the first day of the fiscal year subsequent to the the bill being enacted. So if the bill is passed right away, you need to have filed your I-140 before Oct 1 2007.

Wait for labor (go through labor pain..:-) ), do not get/expect promotion, Oh ya get your well educated spouse, Make them sit at home, make them feel unproductive, pay all your taxes, pay your social security BUT do not expect anything back, In the process if your kids age out separate them from you (send them back), If you wish to study pay highest fees, if you get promoted stand in queue again, pay frequent medical fees, AP, EAD fees, and yes YOU can always TRACK RNs for them. You can whine, post your opinions, when we change policies on the fly and create more hardships even if you have stayed here for more than 6 years, you can call up our customer service, be imaginative and get to level 2 and still get yelled at, asked to wait for 90 days (std reply), etc, but you can always go to good forum like IV and instead of working on your cause, create confusion, DEMAND action, not contribute....etc.

My employer filed I-140 on July 12th and at Nebraska Service Center which must have been deleivered by now. And my employer persist that they cannot file I-485 until I get receipt notice. I even came to know on another thread even without receipt notice I-485 can be filed with an application as a cover letter.
So can I do that myself without the help of the employer or I have to wait for the receipt notice.
Is there any way we can get the info by USCIS by calling them or by taking InfoPass Appointment and asking them..
Please advise. Thanks in advance.

Assuming that you filed earlier and at least you found the receipt number through the cancelled check, it is still risky to file a stand-alone I-485 under the given circumstances. You can ask the USCIS "interfile to XXXXXX" without a copy of the pending I-140 receipt notice, but it is still not recommended. The option may be filing a new concurrent I-140/I-485. But predicament is lack of "original" labor certification. Service Centers have been denying such I-140 petition in a number of cases for lack of original labor certification application. The AILA may attempt to find an answer for this situation, but under the circumstances, you may not have any option other trying filing with the best evidence of I-140 petition filing proof including a copy of the cancelled filing check from the bank, federal or ups overnight delivery tracking record, complete copy of I-140 petition and supporting documentation, and I-485 application and documentation. It is better trying than doing nothing at this point. Or you can wait until first or second week to see whether you will receive the receipt notice of I-140 petition and file I-485 applicatiopn with this receipt notice. Inasmuch as you were eligible in July under the July VB, the extended period of I-485 application may work.
