Trying to use my EB3 date in the EB2 category
Just spoke to an IO at TSC, She told me that the case is at a place what they call "Pending Review and final decision"
I asked her whats the next step after this?
IO : Hope fully will be assigne to some one
I Asked, isn't this the place where all the cases are "Pending Review and Final decision"?
IO: a big NO...no no..this is not the place where all the cases are, I can't provide anymore info then this, I was just being nice because you called at 3:30 pm.
Any body who has thier case in the pool of "Pending review and final decision".
Honestly, I think its just a general status that she told me about my 485 case.

Hi all,
I am on h1b right now but had applied only for AP since i do not have valid stamping on my passport but have an approved renewed h1b extension valid till 2012.
My AP will be expiring coming nov 2009 and have the following questions,
1) How many days before expiry can i apply for the AP renewal. If i apply now the texas processing times for AP is around Apr 1 2009, does it mean the new AP they will provide from Aug 2009 to Aug 2010 or from my AP expiry date which is nov 2009 to nov 2010?
2) I am also thinking of applying for EAD to keep as a backup (just in case).
Can i apply EAD alone now and wait for nov to apply for AP (or should i apply both together) ?
3) If i do a paper based filing does it mean there will be no request for finger printing?

Today I got an SLUD on my pending 485 after almost more than a year. Last one was from July, 2008 (address change). Don't understand what exactly is going on. For RFEs are there usually SLUDs before? or just an hard LUD with message change? Anyone in same boat? :confused:

Currently on H1B 8th year extension which will expire on 25th June, 2009.
Labor PD: 9th August, 2004
Labor cleared: 11th September, 2007.
I-140 (approval pending) filed on 4th October, 2007. Received at USCIS on 5th October, 2007.
Can�t file for I-485 since the EB3 date for India is unavailable.
There is a high chance that I might be laid off at my current employer in the next 2-3 weeks.
Can I transfer my H-1 upto June 25th, 2009 (or later) as well as start a new PERM case in EB2 category?
In case of the above H-1 transfer, will the new H-1 be valid for 1 year from the filing or will it be upto 25th June, 2009?
What are my other options not to go out of status or leave the country?

I am EB3 - Dec 2004 filer and there is no hope for few years that my date get current. i have filed another GC through my sister in May 2006 and that F4 category is moving quicker and expecting my priority date will be current in 5 years through my sister.
i have bought 2 Family house in Jersey City. now for my kids education we thought to move to India for 4 to 5 years until we get call for GC though my sister.
we are going to rent house - it's multi family near NYC. my landloard is willing to take care of it in our absence.
my Q is can we get B1 (Visitor visa) for 10 years , if we show that we have property in US and we may need to visit just to take check it ??
should we inform immigration officer about GC filed though my sister to assure that we will not stay in US longer, to get B1 visa?
can we get visitor visa before leaving USA? i mean converting from H1 to B1 for multi year?
i would appreciate some suggestions.

I have heard in the past from core team and other senior members that
we have to bank on CIR for now, and if it is dead SKIL etc become an option.
The one problem with this might be "how and when would we know CIR is dead, and would it be too late to push for SKIL at that point?".
I understand this is a highly speculative question, but am hoping someone from core can articulate what our game plan regarding contingencies are.
(If this is something you can't answer on the webpage, I can understand the reasons for keeping the gameplan under wraps from our adversaries).

Hello Members,
I noticed that the dates on my i-765, i-131 and i-485 changed to 9/1/2008 today. This has not changed since I got my EAD. None of my wife's dates have changed. Does this mean anything? The things I have done lately that might (or might not) have caused this:
- Called CSR to check on status. She asked me to call back as my processing dates are not current yet.
- my lawyer sent G-28 so they could check on any information for me.
Here is some info:
i-140: 9/26/2005
i-485: 7/23/2007
