My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.
I am planning to go to Ottawa now for a stamp that expires in Sept 08.

Hi,
Got an RFE for my wife to complete the required vaccinations. She did not take 2 required vaccinations when we filed I-485 as we were expecting a baby. USCIS along with the RFE sent the original I-693 form that had been submitted and asked us to present this form to the same surgeon to complete the medical.
Question:
At this point, I believe that USCIS does not have the medical record (I-693) as they returned it to us. Will the surgeon have to give a new I-693 consolidating the new 2 tests + the tests taken earlier? This case we will send a new I-693 comprising of all tests taken to date.
OR
Specify only the 2 tests that are done now and we send to USCIS the returned OLD copy + new COPY with the 2 tests?

USCIS has announced that for the third week in a row, the H-1B count sits at 45,000 out of 65,000 used. It has to be receipt date FIFO, but can never say how USCIS will processes.
With my experience from Backlog Elimination Center's, USCIS works using a pure random function that gets seeded randomly from congress.
Please let me know if 140 processing times is based on receipt date or notice date?
I'm a concurrent 140-485 filer, filed on July 2 2007. My notice date on I-140 says August 16, 2007, where as my friend who filed only140 on july 2 has Notice date of july 12. Does that mean his will be processed first?

I am on H1B and planning to go for CP. I have to fill the form DS-230 for this and submit to VSF office.
Currently I am on H1B extension and I don't have visa stamped for this extension on my passport.
In this form DS-230 I need to fill field name "Present Address".
I have following question:
- In this form what should I fill my present address
Indian address
OR
US address.
(what I think: I think when I will submit the forms to VSF I will be in india and at that time i will not have the valid visa to enter USA. So I think I should fill the indian address.)
What do you guys suggest?

My daughter (5 yrs) is an US citizen and having passport valid until end of Sep 2009 and having POI card for 15 years from Indian consulate.
Now I am planning to take her to India for 3 weeks from Aug 1st week. The travel agents says her passport should have at least 6 months valid from the date of date of the return (Aug 4th week). Is that true/correct? Can she enter here in USA after her India visit with 20 days left in the passport validity?
I will be using my AP though I maintain H1B status (I-797) and work for the same employer.

I was in a similar situation and my lawyer advised to apply for H1 (come April) even without the H4 extension. A query will be sent asking to prove your status until atleast Sep 30th. You can then attach your H4 papers (assuming your H4 extn is approved by then).
Anyway, i am planning to apply for extension using premium processing just to make sure things progress smoothly.

Hi there,
I work for one of big 4 consulting companies. Home office based NJ and live in NJ as well. Travel to Client A mon - thurs.
I rolled off from the project at client A and will be starting at client B.
Both Client A & B are in the same city in MA.
1. Will a LCA update be required even if you new client is in the same city/ state ?
2. How long does it take these days to update the LCA ?
3. Like H1 transfer can you start working at the new client on the USCIS receipt # ?

presently i am working on h1b for a tech company. I also have my ead (obtained as a result of july 07 fiasco).
Can i start a company, incorporate a llc or a class c company on my ead? What would be my options?
i know that if i had solely my h1b, i could start a class c company but not work for it(use a gc or a citizen) to do it
my question is that can i still continue on my status quo--ie use h1 for my employer and use ead to start a company, or i have to give up my h1 status? since my wife is on h4, i have to continue on h1b until she gets her ead.

You can keep extending the H1-B till your Green card is approved.
